Can individual property owners restrict or prohibit cannabis use or possession on their property?

Yes. Any property owner can limit adult-use cannabis use, consumption, possession, transfer, display, transportation, sale or growth of cannabis on his or her property.

What are the rules for new cannabis adult-use stores?

In the City of Sacramento, some medicinal dispensaries may qualify to sell adult-use cannabis. On Nov. 28, 2017, the City Council voted to allow the City’s 30 medical dispensaries to sell adult-use cannabis if they succeed in obtaining a state license after Jan. 1, 2018 and the necessary City permit amendments. They also need to complete a neighborhood responsibility plan and be compliant with all state and local regulations.

Does cannabis smoke fall under provisions of the Clean Indoor Air Act (including those related to hotel/motel rooms and restaurants)?

Yes. The Clean Indoor Air Act prohibits smoking in restaurants and limits the number of hotel rooms in which smoking is permitted.

Can employers restrict or prohibit cannabis use or possession by employees at the workplace?

Yes. Employers are allowed to regulate or prohibit the use, consumption, possession, transfer, display, transportation, sale or growing of cannabis in the workplace. Employers may also enact policies restricting the use of cannabis by employees.
